Copyright and Fair Use
The library views reserves as an extension of the classroom. Therefore, the Library Reserve Policy complies with the fair use guidelines stipulated in the Copyright Law of 1976 and follows the Fair Use Guidelines for Electronic Reserves Systems developed during CONFU: the Conference On Fair Use .
According to these guidelines, the "total amount of material included in electronic reserve systems for a specific course as a matter of fair use should be a small proportion of the total assigned reading for a particular course".
Also, as stipulated in the guidelines, reserve requests are accepted for one semester only.
A new request will have to be submitted each semester for subsequent use of the materials. The library will seek copyright permission for each subsequent use (At this time the library will be also responsible for any copyright fees). If permission is not granted, the library will remove the copy from the reserve collection immediately.
The library will no longer accept any articles/materials acquired through interlibrary loan except under extenuating circumstances (Contact Lizah Ismail, Public Services Coordinator, for more information on extenuating circumstances). Please refer to Copyright Law 1975 Section 108 (e) (1).
The library will either seek copyright permission for those materials or seek an alternative solution.
Exceptions to seeking copyright permission for subsequent use:
- Library owned materials
- Articles obtained from a library full-text research database
- Faculty personal copies that are lawfully obtained (See Personal Copies).
- Materials that fall in the “public domain”. Please refer to the following websites for more information on what constitutes “public domain”.

Types of Reserve
Traditional Reserve
Traditional or general reserve includes both print and non-print items placed on reserve at the request of a faculty member for related coursework.
These items include books, class syllabus and notes, media items (DVDs, CDs, Videos, etc) and other relevant materials to the course.
Electronic Reserve (ERes) Electronic reserve includes items that may be viewed directly from the library online catalog and is an extension of Traditional Reserve.
The library will process all articles (this includes journal articles and book chapters) submitted for reserve as electronic reserve.
ERes materials are password protected (See Accessing Course Reserve Materials From The Library)
Access to these materials is limited to enrolled students and their faculty.
Any item requiring scanning exceeding 25 pages will be limited to hardcopy format and available at the circulation desk.

Permanent Reserve The library will place items on Permanent Reserve if it meets the following criteria:
- Library owned materials that are used heavily
- Library owned materials that are costly and are prone to theft/mutilation

Placing Materials On Reserve
Processing
Materials that are placed on reserve for students to obtain during the first two weeks of the semester need to be submitted at least three weeks before the start of the semester in question.
For the rest of the semester, please allow up to 72 hours processing time (not including weekends) for materials to be placed on reserve.
Library Reserve staff will notify faculty when the requested reserve materials have been processed. Please do not assign reserve materials if no notification has been received.
Faculty are limited to twenty items per course per semester in any format.
Library Reserve Request Form
Faculty need to complete the Reserve Request Form and list citation information accurately. Incomplete and/or inaccurate requests will be returned to the faculty member.

The library will gladly work with any faculty member who needs assistance completing the form or verifying citations.
Reserve requests are therefore accepted for one semester only.

The completed form and non-electronic reserve materials (such as books, media) should be delivered, together with a copy of the class syllabus, at the library’s front desk on the second floor.
Materials That May Be Placed On Reserve
- Any circulating material of the Marywood University Library (books, media, etc)
- Faculty’s personal copies of books and media items
- Student papers (written permission from the student(s) should accompany these materials upon submission to the library reserve)
- Course syllabus, class notes
- Personal copy of textbooks and study guides (provided these are also available for students to purchase – only one textbook and study guide per class)
- One journal article per issue owned by the library
- One chapter or 10% of a print book not owned by Marywood Library. (Every book chapter submitted must have a copy of the title page of the book and must include copyright information of the work)
- Any material for which copyright permission has been granted.
- Non-course related personal or departmental materials used to inform the Marywood community and are in compliance with Fair Use
- The library will seek copyright permission for materials in excess of fair use
- If permission is not granted, the library will remove the copy from Reserve immediately.
Materials That May Not Be Placed On Reserve
- Photocopies of commercial consumable works such as workbooks, exercises, standardized tests, booklets, and answer sheets will not be accepted for reserve without permission of the copyright holder
- Books obtained through Interlibrary Loan
- Periodical articles and/or book chapters obtained through Interlibrary Loan
- Photocopies of complete or substantial portions of copyrighted works
- Non-circulating items of the Marywood University Library such as Reference books and bound journals
- Coursepacks
- Personally reproduced media items
- Articles may not be placed on reserve in both the electronic and print formats at the same time
- Materials from other public/academic libraries
Recommendations
We recommend the use of articles obtained from research databases the library subscribes to We recommend the use of Open Web or Open Access articles (If you need help finding or locating articles in our research databases or Open Access, please let me know).
We recommend the use of books and other items the library owns (If there is a book or item that you use often in class that the library does not own - and you yourself do not own a copy - please let us know, and we may be able to add it to our collection)
Personal Copies
Faculty may choose to place personal copies of lawfully acquired books, journal articles, media, and other materials related to coursework on Reserve.
The library is not responsible for the replacement of lost or damaged personal copies.
Personal copies will be maintained in the library only during the period when the courses for which the reserved materials have been placed are in session.
Personal copies must adhere to copyright restrictions and fair use guidelines.
All personal copies will be returned to the faculty member at the end of the semester.
Removing Items From Reserve The library will not maintain materials on Reserve when class is not in session
All items will be removed from Reserve at the end of the semester.
The library will begin to remove items on Reserve after the last day of Finals.
Only those items within copyright compliance can remain on Reserve indefinitely. (See Permanent Reserves)
Items may be removed from Reserve before the end of the semester. Please contact the library if you choose to do this.
Personal copies will be sent to the faculty member’s office, via campus mail, or will be available for pick-up. (Please indicate on the Library Reserve Form which method is preferred).
Library Reserve Information For Students
Accessing Course Reserve Materials From The Library
To locate materials on library reserve, go to the library website at http://www.marywood.edu/library/.
Click on the “Our Catalog” tab at the top of the page.
Click on “Reserve Desk” tab at the top of the page.
You may look up course reserve items by Instructor’s Name, Course Number, or Course Name.
There are two types of course reserves materials: Electronic Reserve Materials and Traditional Reserve Materials.
Accessing Electronic Reserve Materials
Before attempting to obtain electronic reserves, you need to disable your “pop up blocker” in your computer. Usually, this means you need to go to Tools found on the toolbar of your browser and then click “Options”. You need to uncheck “pop-up blocker”.
Locate your course reserve materials by going to the Reserve Desk. (See Accessing Course Reserve Materials From the Library)
A list of readings should appear.
Click on “Details” and links to either “Media File” or “URL” will be visible.
To obtain the article, click on the “Media File” or “URL” link.
If the article does not appear, your “pop up blocker” may still be enabled. Disable your "pop-up blocker" and click on the title of the article.

Off campus access:
Electronic reserves items are password protected if accessing them from off campus.
Media File link
To access items via the Media File link, you need to login your User ID and PIN at the top of the library catalog page. If you do not know your User ID and PIN, please contact the library circulation desk at 961-4707.
URL Link
To access items via the URL link, you need to login using your username and password that you use to access your email account.
You will be prompted for a username and password after clicking on the URL link.
If you do not know what this is, please contact the Help Desk at 348-2569.
Accessing Traditional Reserve Materials Traditional Reserve Materials such as books and media items are located at the front desk in the library on the second floor.
Materials may be checked out for 2 hours (in house only), 1 day or three days, depending on type of reserve item.
Students will use their IDs to check out items.
Fines will be incurred if reserve items are not returned in the time indicated.
